Judges’ Transfer Case Challenged in Peshawar High Court

According to Beyond Time News, a lawyer has challenged the transfer of three Islamabad High Court (IHC) judges by filing a petition in the Peshawar High Court.

Advocate Hastham Khan Khalil submitted the petition, arguing that the decision violates constitutional principles. Specifically, he asked the court to declare the transfers unlawful, unconstitutional, and against Islamic provisions.

In addition, he requested interim relief, urging the court to suspend the decision until a final verdict is reached.


Government and Institutions Named as Respondents

The petitioner has named several key government bodies and officials in the case. These include federal secretaries of law, human rights, and parliamentary affairs, along with the secretary of the Judicial Commission.

As a result, the case now directly involves both executive authorities and judicial institutions.

Background of the Transfers

The controversy began when the federal government issued a notification under Article 200 of the Constitution. This step followed approval from the Judicial Commission of Pakistan.

Subsequently, Asif Ali Zardari approved the transfer of three judges:

  • Justice Mohsin Akhtar Kayani to the Lahore High Court
  • Justice Babar Sattar to the Peshawar High Court
  • Justice Saman Rafat Imtiaz to the Sindh High Court

Therefore, the decision has triggered legal and constitutional scrutiny.

The petitioner argues that the transfers conflict with Articles 2-A and 175(3) of the Constitution. Furthermore, he claims the executive has overstepped its authority, which undermines judicial independence.

Meanwhile, uncertainty continues within the Islamabad High Court regarding the seniority of judges.

The court has not yet issued a formal seniority list. Consequently, questions remain unresolved until the vacant positions are filled through new transfers.

At present, all seven IHC judges are continuing their duties. They are hearing cases both individually and in division benches.
