IIOJK High Court Quashes PSA Detention of Baramulla Resident

The High Court in Indian Illegally Occupied Jammu and Kashmir (IIOJK) has quashed a detention order issued under the Public Safety Act (PSA) against a Baramulla resident, citing a prolonged delay in its execution.

According to Beyond Time News, the court noted that the detention order remained unimplemented for more than two years, which raised serious concerns about its legal validity.

Challenge Against 2019 Order

Justice Sanjay Dhar heard a petition filed by Altaf Ahmad Waza, who challenged the District Magistrate Baramulla’s detention order dated August 6, 2019.

The petitioner argued that the order was issued without proper reasoning and lacked factual basis. He also said that authorities failed to take meaningful steps to execute it for years.

Security Operations and House Raids Reported in Baramulla, Kashmir

No Action for Years

The court observed that records did not show any serious attempt by the authorities to enforce the detention order between 2019 and 2022.

It held that this long inaction weakened the legal foundation of the detention.

Detention Order Quashed

The court ruled that the delay affected the “subjective satisfaction” of the detaining authority, making the order unsustainable in law.

It accordingly quashed the detention order and granted relief to the petitioner.
